In Spain there are some zones that have restricted access (to buy a property) for non-EU citizens, so that in order to buy a property in this area, a special permit must be requested. This does not affect persons from the EU or from the Schengen area.

 

The Spanish Law on Areas and Installations of National Defense Interest and the regulations that develop it, tell us what these are, and include the islands and islets as fully affected areas. This means that this requirement especially affects people interested in buying a property in the Balearic Islands or the Canary Islands.

 

¿Who is affected by this requirement?

Both natural and legal persons who are non-EU nationals, including also and recently the United Kingdom. It also affects those companies that, although Spanish, more than 50% of their share capital is owned by non-EU nationals.

 

¿What type of property is affected by the military authorisation?

Currently it affects the purchase of those lands that are of a RUSTIC nature.

 

¿What are the consequences of not requesting authorisation to buy a rustic property in Mallorca?

When it is a question of property business, such as a purchase, carried out by non-EU citizens in restricted areas, it is necessary and MANDATORY to register in the Land Registry, so that if this authorisation is not obtained, the business is understood as NOT DONE and therefore CANNOT be registered.

 

The law states that each municipality cannot have more than 15% of properties in non-EU hands and this can be an impediment when it comes to perfecting the purchase, especially in those municipalities with a large non-EU presence such as Calvià (British).

 

¿What documents are needed?

Among others:

-Certified photocopy of the PASSPORT, in force and TRANSLATED by a sworn translator if the passport is not in Spanish.

– In the event that the residence address is not in Spain, it is necessary to provide a translated and valid Criminal Record Certificate from the country of residence.

-GRAPHIC AND DESCRIPTIVE consultation of the land or property.

-Plan OF THE PROPERTY to a scale of not less than 1/500.
